1. By viewing this site the user is deemed to consent to all terms and conditions below. By downloading software from this site the user is deemed to consent to this and the license agreements included with the downloaded software (s).

2. The content of this site is protected by copyright pursuant to Irish and European Union copyright laws, international conventions and other copyright laws. The user is specifically prohibited from modifying, publishing, transmitting, selling, participating in the transfer or sale or reproducing, creating derivative works from, distributing, performing, displaying or in any way exploiting any of the materials on this site or the softwares or materials relating thereto in whole or in part without express written permission.

3. All trademarks on this site such as Infacta and others are trademarks of the respective companies and you may not use these marks without express written permission.

4. Infacta Ltd. excludes any warranty, expressed or implied as to the quality, accuracy, timeliness, completeness or fitness for a particular purpose of the material on Infacta.com and will not be liable for any claims, penalties, loss, damages or expenses arising from the use or the inability to use Infacta materials (site, content and software products), or from any unauthorized access or alteration of Infacta.com.

5. Infacta Ltd. makes no warranty that the contents of the Hool.ie website are compatible with all computer systems and browsers.

6. The user accepts that after leaving the Hool.ie website Infacta Ltd. cannot be responsible in any way for any material that you encounter and we exclude to the fullest extent permitted by law all liability that may arise with respect to or as a result of such material causing any damage, costs, injury or financial loss of any kind.

7. Infacta Ltd. reserves the right to add to or change the terms of this agreement. It is your responsibility to refer to and comply with these terms on accessing Infacta.com and Hool.ie.

8. Infacta Ltd. reserves the right to change all aspects of all Infacta owned properties (site content, software, prices etc.) at any time.

9. These terms and conditions of use shall be construed and interpreted in accordance with Irish Law. The Courts of Ireland shall have exclusive jurisdiction in relation to any claim, dispute or other matter arising there from.

Anti Spam Policy

It is a violation of the license agreement to send unsolicited bulk email with Hoolie.

Notice of Responsibility to all Hoolie users:

DO NOT SEND UNSOLICITED BULK EMAIL OR BULK SMS. Be aware that you are solely responsible for the messages you send. In many cases sending unsolicited bulk email or bulk SMS (i.e. Spam) is in violation of the law, and you will be solely accountable and liable for damages and violations.

We reserve the right to refuse technical support and/or other services if you:

1. send unsolicited bulk email or bulk SMS; or
2. you hijack a mail server relay; or
3. distribute illegal information or materials; or
4. forge header information; or
5. put false of misleading information in the subject; or
6. fail to provide a means for unsubscribing from your lists

Hoolie was developed to help people including us, run and manage mailing lists, newsletters, announcement lists and customer updates and other legal uses. We will never tolerate the use of these products to facilitate the sending of spam messages. We have taken measures to stop people from abusing our products – for example, BCC (blind carbon copying) sending is not permitted – spammers like to be able to send their email quickly – using bcc. This is not possible with Hoolie.

Hoolie does not allow message headers to be altered in anyway, and, most importantly, none of our products facilitate the building of spam lists using extraction or spidering techniques.

If you do receive spam that you believe originated from a Hoolie user, please forward the message with full headers (very important) to hello@hool.ie, so that we can investigate the matter further. Should the spam complaint be valid we will report them to the various anti-spam agencies, black list them from receiving future products and technical support from us. Please note that we (Infacta, the makers of Hoolie) does not provide mailing lists with its products. Hoolie is designed to allow users to operate and manage their own lists and groups.

Privacy & Security

All of us at Infacta take your privacy and security very seriously. This privacy statement discloses our information practices and declares our data collection methods, usage and confidentiality policies throughout our site. At no time do we have access to data on your own personal computer or any data stored in the Hoolie software.

1. Policy Scope
This policy applies to all areas of the Hoolie website. It is the responsibility of linked websites to provide their own privacy policies and we are not responsible for the privacy practices or content of any such websites.

2. The Hoolie Update Newsletter.
While browsing our site you may see several opportunities to subscribe to our Update Newsletter, to join this we require you to provide your e-mail address. We use this address to notify you of new software releases, updates and special offers. For your convenience, each announcement contains instructions on how to be removed from all future mailings. We do not make your e-mail address available to any third parties.

3. During Software Purchase.
It is important to note that Infacta does not process orders or sales directly. In the case of Hoolie all of the ordering and product delivery is handled by Apple Inc. via the Mac App Store. Apple's privacy policy can be viewed here.

4. Technical
Please note that when you contact Infacta support any details you provide us are used only to help solve any issues you have and are destroyed once your issue is dealt with. We do not make any of this information available to any third parties.

5. Cookies.
The area of the site governed by this policy does not use "cookies" (which are small pieces of information that your browser stores on your computer's hard drive), with the exception of anonymous session cookies. A session cookie only ever contains a unique identifier for managing session state and therefore does not contain any personally identifiable information. Session cookies are automatically deleted when the web browser is closed.
